1. Acceptance of Terms

By downloading, installing, or using Moodie ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Moodie is a streaming guide application that provides personalized movie and TV show recommendations based on your mood, available time, and viewing preferences. The App aggregates content information from various streaming services and helps you discover what to watch.

3. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

4. User Accounts

4.1 Account Creation

Some features may require you to connect third-party accounts (such as Trakt or Plex). You are responsible for maintaining the confidentiality of your account credentials.

4.2 Account Responsibility

You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Subscriptions and Payments

5.1 Subscription Plans

Moodie offers subscription plans ("Moodie Pro") that provide access to premium features. Subscription options and pricing are displayed within the App.

5.2 Free Trials

We may offer free trial periods for certain subscriptions. If you do not cancel before the trial ends, you will be automatically charged the subscription fee.

5.3 Billing

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• Subscription prices may change; we will notify you of any price changes in advance

5.4 Cancellation

You can manage and cancel your subscriptions by going to your App Store account settings. Cancellation will take effect at the end of the current billing period.

5.5 Refunds

Refunds are handled by Apple in accordance with their refund policies. We do not process refunds directly.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's operation
• Reverse engineer, decompile, or disassemble the App
• Use automated systems or bots to access the App
• Reproduce, distribute, or create derivative works from the App
• Remove any copyright or proprietary notices from the App

7. Content and Third-Party Services

7.1 Third-Party Content

The App displays information about movies and TV shows, including titles, descriptions, ratings, and artwork. This content is sourced from third-party providers including The Movie Database (TMDB) and is subject to their respective terms and licenses.

7.2 Third-Party Services

The App may integrate with third-party services such as:

• Streaming services (Netflix, Disney+, Amazon Prime Video, etc.)
• Trakt for watch history synchronization
• Plex for local media libraries

Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the availability, content, or practices of third-party services.

7.3 No Streaming Content

Moodie does not stream, host, or provide access to any video content. The App only provides recommendations and information to help you find content on your subscribed streaming services.

8. Intellectual Property

8.1 Our Rights

The App, including its design, features, and functionality, is owned by Moodie and is protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8.3 Third-Party Rights

Movie and TV show information, artwork, and metadata displayed in the App are the property of their respective owners. The use of streaming service names and logos is for informational purposes only.

9. Privacy

Your use of the App is also governed by our Privacy Policy, available at https://moodie.app/privacy. By using the App, you consent to the collection and use of information as described in the Privacy Policy.

10. Disclaimers

10.1 "As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 No Guarantee

We do not guarantee that:

• The App will be available at all times or without interruption
• The App will be error-free or that defects will be corrected
• Recommendations will match your preferences
• Content information will be accurate or up-to-date

10.3 Streaming Availability

We do not guarantee the availability of any movie or TV show on any streaming service. Content availability varies by region and is subject to change by streaming providers.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MOODIE, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers
• Any interruption or cessation of transmission to or from the App
• Any bugs, viruses, or other harmful code transmitted through the App
• Any errors or omissions in any content

12. Indemnification

You agree to indemnify, defend, and hold harmless Moodie and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the App or violation of these Terms.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or on our website. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

14. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

16. Dispute Resolution

Any dispute arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in California, and the arbitrator's decision shall be final and binding.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Moodie regarding your use of the App and supersede any prior agreements.
